Grandparent Visitation Lawyer in Albuquerque, NM
What Does New Mexico Law Say About Grandparent Visitation Rights?
Grandparents generally have the ability to visit and spend time with their grandchildren at the consent of the parents. However, Chapter 40 of the New Mexico statutes provides several circumstances where grandparents may seek court orders for the right to visitation. Under certain circumstances, the state’s courts will enter orders providing grandparents with visitation rights, such as if a child’s parents have passed away or a child has lived with the grandparent(s) for a specific period.
If you have any matters to settle related to grandparent visitation rights, turn to The Mulcahy Law Firm. Led by skilled family attorney Rebecca Mulcahy, our firm provides personalized legal services that put our clients’ interests, concerns, and rights first.

- If the child has lived with the grandparent(s) for at least three months before turning six
- If the child has lived with the grandparent(s) for at least six months after turning six
- If the child has been adopted by a stepparent, relative, a designated caregiver, or someone who sponsored the child’s baptism or confirmation in a religious organization

What Courts Consider in Grandparent Visitation Rights Cases
Courts will consider several factors to determine whether to allow grandparent(s) visitation rights. Among these factors are the relationship between the child and grandparent(s), the effect the visitation arrangement may have on the child’s well-being, and whether the grandparent(s) have been the child’s primary caretaker at any time previously. Once in place, modifying or enforcing a visitation arrangement is possible.
It is important to note that if you are a grandparent seeking visitation rights, you must generally demonstrate your positive relationship with the child and ability to provide a stable and safe environment for them. Doing this is not always easy. However, enlisting the help of a knowledgeable family law attorney who can tell your story and guide you through the necessary legal processes can increase your chances of success.

The Role of Mediation
In some cases, family law courts will order mediation before ruling on a grandparent visitation rights case. This allows parties to discuss the issue at hand and reach an agreement without appearing in court. Mediation is useful for resolving all kinds of family law conflicts; plus, it can lessen the stress of the dispute resolution process by encouraging open, amicable communication between parties, which is valuable in cases involving children. Additionally, mediation is often less expensive and time-consuming than litigation.
